Governance Arrangements

Ministerial Council for Education, Early Childhood Development and Youth Affairs (MCEECDYA)

The Ministerial Council for Education, Early Childhood Development and Youth Affairs (MCEECDYA):  

  • Oversees implementation of the National Quality Framework (NQF)

  • Makes the Education and Care National Regulations

  • Appoints members of AECQA Board Australian Children’s 

  • Develops and oversees a set of national standards for teaching and school leadership and implements an agreed system of national accreditation of teachers based on these standards; and promotes excellence and national leadership in the professional development of teachers, educators and school leaders.

The Australian Children’s Education and Care Quality Authority (ACECQA) is the independent national authority that assists governments in administering the National Quality Framework (NQF) for children’s education and care.

ACECQA works with the Australian and state and territory governments to:

-implement changes that benefit children birth to 13 years of age and their families

– monitor and promote the consistent application of the Education and Care Services National Law across all states and territories

– support the children’s education and care sector to improve quality outcomes for children.

State / Territory based Regulatory Authority

The Department of Education (the department) is the Regulatory Authority in Victoria, and is responsible for: all provider and service applications and approvals making sure NQF services meet the requirements of the National Law and National Regulations carrying out the quality assessment and rating process monitoring compliance with the National Law and Regulations, and the Children’s Services Act and Regulations investigating any complaints received, or information that alleges that offences have been, or are being committed that pose a risk to the safety, health or wellbeing of any child at an early childhood service taking compliance or enforcement action against a provider, service or nominated supervisor for an offence under either the National Law and Regulations (NQF) or the Children’s Services Act. The National Quality Framework (NQF) operates under an applied law system, comprising the Education and Care Services National Law and the Education and Care Services National Regulations. The purpose of the applied law system is to set a national standard for children's education and care across Australia. The National Law and National Regulations outline the legal obligations of approved providers, nominated supervisors, and educators and explain the powers and functions of the state and territory regulatory authorities and ACECQA.

Rating And Assessment

All centres, Australia wide, are assessed by their state/territory regulatory authority to ensure that they are meeting the National Quality Standards. Each Choklits Centre is assessed inline with these requirements and all currently maintain a minimal rating of ‘meeting national quality standards’.
